The Economic Collegium of the Supreme Court reiterated that demolition is an exceptional measure.

A shop built on a garden plot with municipal permits was challenged as an unauthorized structure. The Supreme Court held that a different use alone does not make a building unauthorized, and demolition requires proof that the object cannot be brought into compliance.
