On 22 December 2025 the Presidium of the Supreme Court of the Russian Federation approved Review of Judicial Practice of the Supreme Court of the Russian Federation No. 4 (2025).

On 22 December 2025 the Presidium of the Supreme Court of the Russian Federation approved Review of Judicial Practice of the Supreme Court of the Russian Federation No. 4 (2025).

In particular, disputed issues relating to protection of ownership and other proprietary rights:

1. Where a local self-government body unlawfully refuses to transfer a land plot into a citizen’s ownership, rent for that plot may not be recovered in an amount exceeding the land tax that would have been payable.

2. A gardening partnership member’s right to acquire free of charge the land plot allocated to them may not be made dependent on the partnership’s failure to register the fact of its creation.

3. Partition of a residential house with creation of townhouse-type (blocked) development objects is permitted if urban-planning and land legislation requirements are met.
