Owning a land plot is not only a right, but also an opportunity to use the land effectively. What if the current designation — for example, “for gardening” — does not allow your plans? There is a solution: changing the permitted use type (VRI). It is an achievable procedure.
Important!
Changing the VRI does not change the land category (for example, from agricultural land to settlement land). The procedure only adjusts permitted uses within the existing category.
Step 1: check the regulations — Land Use and Development Rules (PZZ)
You cannot switch to any VRI you prefer. You must follow:
1. The municipal PZZ (available on the local administration website). The territory is divided into zones (residential, commercial, industrial, etc.). Each zone has an urban-planning regulation listing principal, conditionally permitted, and accessory VRIs.
2. The VRI Classifier (Order of the Ministry of Economic Development of the Russian Federation No. 540). The new VRI must match the Classifier wording exactly.
Step 2: choose the procedure depending on the type of VRI
Option A: the simplest route. If the desired VRI is among the principal VRIs, the procedure is largely an administrative update in the Unified State Register of Real Estate (EGRN). Prepare an application, attach an EGRN extract, the owner’s passport, and the title document. File via MFC, Rosreestr, or Gosuslugi. Within about 7 business days the new VRI is entered in the EGRN.
Option B: a more complex route affecting neighbors and the public interest. It requires public hearings. The owner applies to the local administration; hearings are held; a decision is made; and, if approved, the change is registered with Rosreestr. The process may take 2 to 4 months.
Possible risks: refusal to change the VRI; a change in cadastral value and land tax; decisive input from local residents for a conditionally permitted VRI.
Short checklist: study the PZZ; check the VRI Classifier; identify the desired VRI type; collect documents; file the application; await the decision and register the change in the EGRN.
Changing the VRI is a lawful tool for using land more effectively. Act sequentially and within the legal framework. If the situation is unclear, obtain a preliminary consultation with a land attorney.
